Terms and Conditions

This website is owned and operated by Glow Up Lab. The following Terms and Conditions govern the access to, and use of, Glow up Lab service, website, online store and products.

Glow Up Lab asks all customers to read the following carefully before making a purchase. Once you have engaged with our service, we will assume you have read our Terms and you will, therefore, be bound by them, at all times, without exception. 

Any reference to ‘us’, ‘our’ or ‘we’ refers, at all times, to Glow Up Lab. Any reference to ‘you’ or ‘your’ refers to our customers and website visitors.

 Service and Liability

Glow Up Lab reserves the right to refuse access to those that we deem as having misused our service in any way, in contravention of our Terms and Conditions or otherwise. We retain the right to make amendments to our service, brand, products or prices, at any time without notice or consequence. Glow Up Lab acknowledges that not all individuals are suitable for tooth whitening treatments or procedures, Oral and Skin products. It is your responsibility to determine if the product or treatment is right for you in coordination with your dental care provider and Dermal Therapist provider. Individual results may vary for all skin and dental products. The customer agrees to use each product only as directed. 

To the maximum extent permitted by law, including the Australian Consumer Law, in no event shall we be liable for any direct and indirect loss, damage or expense – irrespective of the manner in which it occurs – which may be suffered due to your use of our website and/or the information or materials contained on it, or as a result of the inaccessibility of this website and/or the fact that certain information or materials contained on it are incorrect, incomplete or not up-to-date.

Your use of the website and these Terms are governed by the law of Victoria and you submit to the non-exclusive jurisdiction of the courts exercising jurisdiction in Victoria.

Purchases and Orders 

Glow Up Lab products can be purchased through our online store. Customers are welcome to browse our product range and are encouraged to contact us for further information or recommendations.

In Australia, our goods and services come with guarantees that cannot be excluded under the Australian Consumer Law. Nothing in these terms and conditions purports to modify or exclude the conditions, warranties and undertakings, and other legal rights, under the Australian Competition and Consumer Act and other laws. Any and all other warranties or conditions which are not guaranteed by the Australian Consumer Law or the Competition and Consumer Regulation 2010 are expressly excluded where permitted, including liability for incidental or consequential damages caused by breach of any express or implied warranty or condition.

When making an order, you must follow the instructions on the website as to how to make your order and for making changes to your Order before you submit it.

Once You select a product that you wish to order, irrespective of any previous price you have seen or heard, you will then be shown or told (on the website) the price you must pay including GST and any other charges, including any unless otherwise stated all charges are in Australian Dollars.

You must pay for the order in full at the time of ordering by one of the payment methods we provide on the Site. You must be fully entitled to use the payment method or account used for purchases. The payment method or account must have sufficient funds or credit facilities to cover the purchase. We reserve the right to obtain validation of your payment details before providing you with the product and carry out security checks from time to time.

If you discover that you have made a mistake with your Order after you have submitted it to the website, please contact Glow Up Lab at hello@glowuplab.com.au immediately. However, we cannot guarantee that we will be able to amend your order in accordance with your instructions.

When you place an Order, you will receive from us a Confirmation of Order by email. This email will only be an acknowledgement and will not constitute acceptance of your order. A contract between us for the purchase of the goods will not be formed until you receive a shipment confirmation email from us. We are not obliged to supply the product to you until we have accepted your order. We may in our discretion refuse to accept an order from you for any reason, including but not limited to unavailability of stock or we may offer you an alternative product (in which case we may require you to re-submit your order).

Cancellations

Until the time when we accept your order, we reserve the right to refuse to process your order and you have the right to cancel your order. If we or you have cancelled your order before it has been accepted, we will promptly refund any payment already made by you to your original payment method.

Glow Up Lab will always endeavour to package and ship orders the same or next business day. For this reason, we are unfortunately unable to accept any cancellations on orders.

We may terminate a Contract if the product is not available for any reason. We will notify you if this is the case and return any payment that you have made. We will usually refund any money received from you using the same method originally used by you to pay for the product.

If you wish to cancel your order, please contact Glow Up Lab at hello@glowuplab.com.au. No cancellation fees will apply. Once an order has been processed it cannot be cancelled and returns are only available in line with the Returns and refunds Policy – see returns and refunds policy section.

Lost, damaged or delayed parcels

Any delays experienced after your order has been dispatched will need to be followed up with our parcel carrier, Sendle. You can track your items following the link provided in your dispatch email.

In the event of a missing or damaged parcel, an investigation will need to be lodged with Sendle by the customer by contacting them and quoting the tracking number provided.  

Returns & refunds policy

If any of your products have arrived faulty, damaged or incorrect, please contact Glow Up Lab directly via e-mail within 24 hours of receiving the goods at hello@glowuplab.com.au. We may require corresponding photographs to properly assess your product. If it is declared faulty we will provide a replacement product as soon as possible.

As our items are personal care goods, unfortunately they cannot be returned. We are unable to provide exchanges or refunds simply for a change of mind. Our friendly team is always available to assist you in selecting the right products for you.

Product information and safety

Please pay close and careful attention to any and all product safety guidelines or instructions that might be on your product label, accompany your order or that are listed on our website in product descriptions. These instructions are important and customers will be responsible for ensuring that products are only used in strict accordance with them.

Glow Up Lab will not be responsible for any consequences that may flow from the incorrect or misuse of our products due to non-compliance with our product instructions or recommendations.

Please read ingredient lists to check for personal allergens. Please seek advice from your dental and skin professional if you are unsure if these products are suitable for you.

Errors, Inaccuracies and Omissions

Occasionally there may be information on our site or in the Service that contains typographical errors, inaccuracies or omissions that may relate to product descriptions, pricing, promotions, offers, product shipping charges, transit times and availability. We reserve the right to correct any errors, inaccuracies or omissions, and to change or update information or cancel orders if any information in the Service or on any related website is inaccurate at any time without prior notice (including after you have submitted your order).
We undertake no obligation to update, amend or clarify information in the Service or on any related website, including without limitation, pricing information, except as required by law. No specified update or refresh date applied in the Service or on any related website, should be taken to indicate that all information in the Service or on any related website has been modified or updated.

Feedback, user comments and other submissions

If, at our request, you send certain specific submissions (for example contest entries) or without a request from us you send creative ideas, suggestions, proposals, plans, or other materials, whether online, by email, by postal mail, or otherwise (collectively, 'comments'), you agree that we may, at any time, without restriction, edit, copy, publish, distribute, translate and otherwise use in any medium any comments that you forward to us. We are and shall be under no obligation (1) to maintain any comments in confidence; (2) to pay compensation for any comments; or (3) to respond to any comments.
We may, but have no obligation to, monitor, edit or remove content that we determine in our sole discretion are unlawful, offensive, threatening, libelous, defamatory, pornographic, obscene or otherwise objectionable or violates any party’s intellectual property or these Terms of Service.
You agree that your comments will not violate any right of any third-party, including copyright, trademark, privacy, personality or other personal or proprietary right. You further agree that your comments will not contain libelous or otherwise unlawful, abusive or obscene material, or contain any computer virus or other malware that could in any way affect the operation of the Service or any related website. You may not use a false email address, pretend to be someone other than yourself, or otherwise mislead us or third-parties as to the origin of any comments. You are solely responsible for any comments you make and their accuracy. We take no responsibility and assume no liability for any comments posted by you or any third-party.

Promotions

Glow Up Lab may occasionally run promotional offers for our customers, followers and website subscribers. These may be advertised through our social media accounts or e-mail promotions. Such special offers may include, but are not necessarily limited to: special prices, discount codes, giveaways, competitions, two for one offers, or spend and save offers. Each promotion will run for a limited time only and may have specific conditions or guidelines, which must be fully complied with, without exception, in order to validly redeem the promotion.

Some promotions may require you to share personal information with Glow Up Lab. Any information shared in this capacity will be dealt with, at all times, in accordance with our Privacy Policy. Please refer to this policy for more information. Special or sale prices may only be applicable for certain periods of time.

Discount codes must be entered at checkout, before proceeding to the payment page. No discounts will be applied retroactively. Discounts and offers cannot be used in conjunction with any other offer and postage fees may apply.

Prizes won in promotional giveaways are not transferable or redeemable for cash.

Glow Up Lab reserves the right to modify, suspend or cancel any promotion at any time, without consequence.

There will be no rain-checks permitted on any kind of promotion.

Promotions (competitions and giveaways) promoted on our social media accounts, including Facebook and Instagram, are in no way sponsored, endorsed or administered by, or associated with, Facebook and/or Instagram.

All entries are open to residents of Australia only who are aged 14 years and over and have an account on Instagram and/or Facebook, enabling them to submit an entry in accordance with the entry details specified in the promotion post.

Instructions on how to enter each competition or giveaway form part of the conditions of entry as outlined in our Promotion Terms & Conditions. By participating, entrants agree to be bound by these conditions.

A random comment picker tool is used to randomly select winners of giveaways. Instagram Random Comment Picker is a simple free tool to easily generate a winner of an Instagram contest or giveaway. By entering the URL of the Instagram post/s, all comments are retrieved and the system randomly chooses a winner.

Certain content, products and services available via our Service may include materials from third-parties.
Third-party links on this site may direct you to third-party websites that are not affiliated with us. We are not responsible for examining or evaluating the content or accuracy and we do not warrant and will not have any liability or responsibility for any third-party materials or websites, or for any other materials, products, or services of third-parties.
We are not liable for any harm or damages related to the purchase or use of goods, services, resources, content, or any other transactions made in connection with any third-party websites. Please review carefully the third-party's policies and practices and make sure you understand them before you engage in any transaction. Complaints, claims, concerns, or questions regarding third-party products should be directed to the third-party.

Glow Up Lab is not responsible for the acts or failures to act, wilfully, lawfully or otherwise, of its suppliers, or of any other third party over whom Glow Up Lab has no control.

Modifications to the service and prices

Prices for our products are subject to change without notice.
We reserve the right at any time to modify or discontinue the Service (or any part or content thereof) without notice at any time.
We shall not be liable to you or to any third-party for any modification, price change, suspension or discontinuance of the Service.

Your submission of personal information through the website is governed by our Privacy Policy. Please refer to our Privacy Policy section.

By subscribing to Glow Up Lab, we will use your subscribed e-mail address to keep you up to date with Glow Up Lab products, promotions, sales, giveaways and more.

Unless otherwise indicated, we own or license from third parties all rights, title and interest (including copyright, designs, patents, trademarks and other intellectual property rights) in this website and in all of the material (including all text, graphics, logos, audio and software) made available on this website (Content).
